Below you will find the Terms and Conditions of WELLDONE s.r.o., who you are about to do business with. By purchasing our products at www.kompot.sk, you consent to the following Terms and Conditions.

Private Data Protection (GDPR) and Registration



2.1 Purchase without Provision of Personal Data
Naturally, it is possible to shop in Kompot anonymously. We are looking forward to seeing you at our brick and mortar shop on Laurinská 19, Bratislava.

2.2 Purchase via E-shop
In our e-shop you can shop either as a registered customer or without registration. In both events, we must process the information, ie personal data, we receive. We protect personal data in compliance with Act No. 122/2013 Coll. on Protection of Personal Data in Information Systems.

By registering at www.kompot.sk or by submitting your order, you consent to have your personal data processed in compliance with Act No. 122/2013 Coll. on Protection of Personal Data as amended.

Provision of personal data is voluntary. You may retract your consent at any time in writing sent to our postal address. Consent expires one month after the delivery of the retraction of your consent and your data will be erased.

2.2.1 Purchase without Registration
You may submit your order without registration. However, even in this case we cannot refrain from processing information considered personal data. We will need mainly the following data:

• first name and surname,
• delivery and invoice address,
• telephone number, and
• e-mail address.

We use your data solely for the purposes of processing your order and delivery of goods, for the time period material to the fulfilment of the contract by the seller.

Several times a year, we would like to send a newsletter on what is new in Kompot to your e-mail address specified in the order. In the event you do not wish to receive such information, let us know by replying to a particular e-mail newsletter.

2.2.2 Purchase with Registration
Our e-shop offers customers the possibility to register. In such a case, you will create your own profile on www.kompot.sk with data that you can reuse later for any subsequent orders. When registered:

• Your data will be automatically filled in, you will not have to fill them in every time you shop;
• We will send you information on news and sales at Kompot (if you do not wish to receive our newsletter, you can unsubscribe at any time by replying to a particular e-mail newsletter).

2.3 Provision of Personal Data to Third Parties
We do not disclose, make available or provide your personal data to any third parties, except organisations we cooperate with in order to correctly process, handle and deliver your orders. These organisations include mainly banks (eg for verification of payment by bank transfer), the Slovak Post and other delivery services.

For statistical reasons, WELLDONE s.r.o. evaluates information on the usage of www.kompot.sk (eg number of users visiting our webpage, where the web page was accessed from). This information is solely numeric (without personal data) and will be used for internal analyses in order to improve the quality of our webpage.

All materials and information on Kompot’s webpages are solely the intellectual property of WELLDONE s.r.o. or persons cooperating therewith. These materials and information cannot be used or amended in any way without the consent of WELLDONE s.r.o.

2.4. GDPR
Information to be provided by the Controller in accordance to Articles 13 and 14 of the REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter “Regulation”).

In connection to the processing of personal data of data subjects, the controller provides applicable information in accordance with Articles 13 and 14 of the Regulation.

Purposes and legal basis for the processing: the controller processes the personal data of data subjects – clients and clients’ representatives for the following purposes:

Photographs – identification purposes, to promote the employer,
E-shop – sales of goods to customers of e-shop,
Consumer contests – organization of consumer contests,
Clients – fulfilling the rights and obligations in accordance to contractual commitments,
Warranty claims – processing warranty claims.

Rights of data subjects:
i. right of access to the personal data concerning him or her,

v. right to object to the processing of personal data concerning him or her,
vi. right to data portability,
vii. right to withdraw consent for the processing of his or her personal data at any time,
viii. right to lodge a complaint with a supervisory authority.

The abovementioned rights apply to data subjects in accordance with Articles 15 to 21 and Article 77 of the Regulation. The data subject may exercise his or her rights orally, in writing or in electronic form using the abovementioned contact information. If the data subject requests the information to be provided orally, it will be done so after proving his or her identity.

Information on the source of personal data: personal data regarding the data subject were acquired from the following source: customers entering contact information for the purposes of online shopping.

Price and Fees



Prices of all goods and services are listed including their respective VAT (10% for books, 20% for other goods). Postage and packaging fees are charged separately. Discount prices are valid up to the date specified in the product details or until out of stock. In the event of wrongful interference with the content on www.kompot.sk or with the order, we reserve the right to change the price. You will always find the final price of your order in the order form right before submitting the binding order. In the event of selecting the “cash on delivery” payment method for orders to the Czech Republic, the price is calculated using the current daily EUR/CZK exchange rate.

Order of Goods



Goods are ordered by submitting an order to www.kompot.sk.

It is not possible to order over the telephone. Every order must be recorded in the accounting system, so that we are can issue a purchase receipt and get records for our accounting books.
You may submit orders to www.kompot.sk either as a registered user or without registration. By registering and creating a profile on www.kompot.sk, you gain advantages described in 2.2.2 Purchase with Registration.

Creating an order consists of four simple steps that you will complete after putting the selected items in your shopping cart. We advise you to carefully read the instructions on exercising consumer rights regarding contract termination and our Terms and Conditions. After you submit your binding order by clicking on “order with obligation to pay” you will immediately receive a confirmation of receipt at the e-mail address specified in your contact information.

Payment Methods



When purchasing goods via the e-shop, you may use one of several payment methods:

• payment on site in cash or by card (in case of in-store pick-up),
• cash on delivery,
• noncash payment using electronic banking services, and
• bank transfer/deposit into account of WELLDONE s.r.o.

5.1 Payment on site in cash or by card
In the event you would like to pick up and pay for goods ordered on the internet in person, you may pay on site in cash or using a payment terminal.

5.2 Cash on delivery
Using the “cash on delivery” delivery and payment method is possible only within the Slovak and Czech Republic. You will pay for your order upon delivery to the GLS courier.

In this case, charge for courier service is EUR 5.00; for orders over EUR 60.00 postage and packaging are free of charge.

5.3 Noncash Payment by Electronic Banking Services
You may pay for any orders using noncash payment methods:

• CardPay
• TatraPay
• PayPal

Noncash payment is mandatory for orders from abroad with delivery outside the Slovak or Czech Republic as well as for deliveries using a courier service within the Slovak Republic.

5.4 Bank Transfer/Deposit into Account of WELLDONE s.r.o.
This payment method is used only in certain cases, eg failure of a noncash payment using electronic banking services or in the event of other financial settlements between WELLDONE s.r.o. and the customer (eg returns). The whole procedure and conditions will be agreed upon using e-mail communication.

Means of Delivery/Receipt of Goods



Goods ordered via www.kompot.sk can be delivered the following ways:

• in-store pick-up – pay in-store/paid in advance,
• GLS courier services.
• using the services of the Slovak Post – delivery out of Slovak and Czech republic

 

6.1 In-store pick-up
If you select the “in-store pick-up” delivery method in your order, you can pick up the goods directly at the store on Laurinská 19, Bratislava. This method for reservation and delivery of goods is free of charge.

6.1.1 In-store pickup – pay in-store

• Order of goods – select the “in-store pick-up” option, you do not pay for goods in advance.
• Order confirmation – after completing your order, you will receive confirmation by e-mail and sms notification containing basic information about your order.
• Availability of goods – after completing your order you will receive an e-mail and sms notification regarding availability of goods.
• Reservation period – goods will be reserved for you for 5 working days.
• Pick-up of goods – in person in our store on Laurinská 19, Bratislava, based on the name or order number, payment method – on-site in cash or card.

If you do not pick up your order within 5 working days, it will be automatically cancelled.
In the event you would like to prolong the duration of your reservation, please contact us by e-mail or phone. It is possible to change the order or add items on-site before payment.

6.1.2 In-store pickup – paid in advance

• Order of goods – select the “in-store pick-up” option, pay for goods in advance by electronic banking services or PayPal.
• Order confirmation – after completing your order, you will receive confirmation by e-mail and sms notification containing basic information about your order.
• Availability of goods – after completing your order you will receive an e-mail and sms notification regarding availability of goods.
• Reservation period – goods will be reserved for you for 10 calendar days, after this time period, we will contact you and discuss the possibilities of prolonging your reservation.
• Pick-up of goods – in person in the store on Laurinská 19, Bratislava, after identity confirmation with a valid ID and order number, hereafter you will acknowledge receipt of goods with your signature.

If you are unable to pick up goods personally, let us know by e-mail who will pick up the goods instead. Thus, we can ensure the goods will be handed over to the right person.

6.2 Courier services GLS within Slovak and Czech Republic

You can use this delivery method only:

• on working days,
• within the Slovak and Czech Republic

Charge for delivery by GLS courier is EUR 5delivery within 2 days since pick up by courier. If your order is over EUR 60, delivery is free of charge.

Delivery by courier services is available only on working days. If you place an order and specify “courier” as your delivery method during the weekend or public holidays, the deadline for delivery will be calculated from the next working day.

6.3 Delivery to a post office/delivery to an address
If you select delivery adress out of Slovak and Czech republic, it will be delivered using the services of the Slovak Post. In this case the postage and packaging charges are EUR 9.90; for orders over EUR 60.00 postage and packaging are free of charge.

Order Dispatch and Delivery Conditions (Slovakia, courier in Slovakia, the Czech Republic, abroad)



7.1 Delivery Terms and Conditions
WELLDONE s.r.o. is obliged to deliver ordered goods at the latest within 30 calendar days from the date of order confirmation. Obligation to deliver goods is fulfilled when we deliver the goods to you or a third party specified by you, or by handing the shipment to our shipper for delivery. If you do not accept ordered goods that were properly delivered to the delivery address specified in the order/order confirmation or do not pick up ordered goods specified for in-store pickup, WELLDONE s.r.o. has the right to claim reimbursement in the amount of expediently incurred costs related to order dispatch. You acquire ownership rights to the goods by accepting the goods at the specified delivery point and by paying the full cost. By accepting the goods, the risk of accidental loss and accidental deterioration passes onto you. If the shipment is visibly damaged, you are entitled not to accept the shipment.

Order dispatch and selected delivery conditions differ depending on the delivery method and place of delivery:

• delivery by courier services within the Slovak and Czech Republic, or
• worldwide delivery by the Slovak Post.

The precise dispatch conditions for individual instances are described below.

7.2 Order Packaging
Depending on the character/brand of the ordered goods, we will either pack it in a special authorial package (mason jar, paper bag with original stamp etc.) or in a plastic zip bag, that we will subsequently place in a cardboard box or a white plastic bag. T-shirts to be delivered abroad (except the Czech Republic) are sent without a mason jar.

7.3 Division of Order – Dispatch and Postage
If your order consists of several items, and one or more items cannot be dispatched due to situation out of our control, we will dispatch the order in instalments. In this event the higher postage and packaging charges will be covered by us.

In the event one order gets divided into several shipments based on your wish specified in an e-mail, we may charge postage fees for each shipment separately.

7.4 Confirmation of Order Dispatch
You will receive a confirmation e-mail from us within 24 hours of order dispatch. Read the e-mail carefully. It will contain useful information on possible complications regarding delivery. In the event of unforeseen circumstances, we reserve the right to prolong the term of delivery, however, we will inform you of such fact without delay. Goods will be delivered to you in a cardboard package with a characteristic look.

7.5 Problems with Delivery of Dispatched Order
If you do not receive the goods or notice of delivery within the term of delivery, please contact your post, GLS courier service or us:

7.6. Dispatch of Orders by Delivery Method and Place of Delivery

7.6.1 Dispatch of Orders Delivered by GLS within the Slovak and Czech Republic
In the event of ordering goods using the courier delivery method, it is possible to pay for goods in advance or "cash on delivery". Goods are delivered within 2 days since pick up by courier.

These time periods do not apply to goods categorised as pre-orders. These types of goods have their delivery terms specified separately.

7.6.2 Dispatch of Orders to be delivered ABROAD (outside Slovakia and the Czech Republic)
Goods are considered delivered at handoff. We are able to deliver goods worldwide. In such event you have to pay in advance using CardPay, TatraPay or PayPal services. Such orders will not be processed further without payment in advance and will be considered void.

In this case the postage and packaging charges are EUR 9.90. For orders over EUR 60.00 postage and packaging are free of charge.

Unless otherwise specified, we customarily dispatch goods within 5 working days, however at the latest within 14 calendar days upon receiving a successfully completed order or after order authorisation. If the goods are out of stock, we will notify you without delay in order to discuss further steps.

WELLDONE s.r.o. is not in any way liable for late delivery caused by the post nor for damage to the shipment caused by the post. WELLDONE s.r.o. is also not in any way liable for you incorrectly filling in the delivery address.

Warranty Period



By law, there is a 24 month warranty for all goods that starts as of the day of goods delivery.

Every shipment includes an invoice that doubles as a warranty certificate. If you have not received an invoice, let us know as soon as possible at info@kompot.sk

Warranty claims in our store are governed by conditions used in any common brick and mortar store in compliance with the law.

Exchange, Returns and Warranty Claims



9.1 Exchange
Goods purchased via our e-shop can be exchanged for other goods within 24 months after purchase.

9.1.1 Exchange Conditions

• Goods you wish to exchange must NOT be damaged, used and/or washed.
• You do not need to return goods in its original packaging, ie we exchange goods without a mason jar (or other packaging).
• In the event you wish to exchange goods by post, do not send them to us using the “cash on delivery method”, we will not accept such a shipment.

9.1.2 Exchange Process – Customer

• Bring the goods you want to exchange in person to Laurinská 19, Bratislava or sent it as a signed for package or letter (not “cash on delivery”).
• Address for delivery of returned goods:

• To exchange goods you will need a copy of purchase receipt.
• Make sure the goods for exchange are in order, not damaged, without packaging.
• Include a copy of the receipt and accompanying letter with information regarding the demanded exchange in the package or letter with the goods.

9.1.3 Exchange Process – Provider
• We will check the received goods, read the accompanying letter and verify availability of goods, you wish to obtain.
• In the event you wish to exchange an item for an item with the same price and at the time it is available, we will send it to you in a signed-for letter or package without delay to the specified address.

9.1.4 Exchange Process – Special Events
In the event you wish to exchange goods for items with a different price or if the goods you are interested in are currently unavailable, we will discuss the reimbursement of the price difference individually by e-mail or phone. In such cases we recommend to notify us in advance at info@kompot.sk.

9.2 Returns
If you are a consumer, you can return all goods purchased via our e-shop www.kompot.sk without submitting a specific reason and without any penalties within 14 calendar days after you or a third party specified by you (except the carrier) received the goods. If you decide to use this right, you must send a contract termination notice to Kompot at the latest on the fourteenth (14) day after goods delivery. You can use your right to contract termination by e-mail at info@kompot.sk or in writing to WELLDONE s.r.o., Laurinská 19, 811 01 Bratislava together with a signed written declaration on the contract termination that specifies your name and surname, address, order number, date of order and bank account number for financial reimbursement. You can also use a form for contract termination (if you use this option, we will confirm receipt of the termination notice without delay by e-mail).

9.2.1 Conditions for Returns
• Goods you wish to return must NOT be damaged, used and/or washed.
• In the event you received goods packed in a mason jar and did not take the T-shirt out, you can return it as is. In other cases (unpacked), please return goods without original packaging.
• In the event you wish to return goods by post, do not send them to us using the “cash on delivery” method, we will not accept such a shipment.

9.2.2 Returns Process – Customer
• Bring the goods you want to return in person to Laurinská 19, Bratislava or sent them as a signed for package or letter (not “cash on delivery”) at the latest within 14 calendar days upon using your right to terminate the contract. The time period is considered observed, if you send the goods back before the 14 day period lapses.

• To return goods you will need a copy of the receipt.
• Make sure the goods for return are in order, not damaged, without packaging.
• Include a copy of the receipt and form for contract termination (form for contract termination) in the package or letter with the goods.

9.2.3 Returns process – provider
• We will check the received goods and whether the time period for returns has been observed.
• If everything is in order, we will return all payments that you made when entering the contract, mainly the purchase price including the delivery costs. That does not include additional costs, if you have chosen a delivery method other than the cheapest most common delivery method we offer. The payments will be returned without further delay, at the latest within 14 calendar days after we receive your notification of contract termination. Payments will be returned using the same payment method you used, if you expressly disagreed with other payment methods, and without adding any additional charges.
• Payment for purchased goods will be reimbursed only after the returned goods are delivered back to our address or after presenting a record confirming the goods have been dispatched, depending on what is first.
In the event of contract termination, you bear the costs of returning goods to WELLDONE s.r.o. You are liable only for any decrease in the value of the goods that occurred due to being handled in any other way than required for determining the character, properties and functionality of the goods.

In the event you do not meet some of the aforementioned conditions in compliance with the Terms and Conditions, the contract termination is not valid and effective, and WELLDONE s.r.o. is not required to return all provably incurred costs in compliance with the Terms and Conditions, and is also entitled to be reimbursed for costs related to returning the goods back to you.

9.3 Warranty Claims

9.3.1 Basic Information

Warranty period for all goods purchased in our e-shop www.kompot.sk is 24 months.

In some cases we will process the claim at once, however at the latest within 30 days after receiving goods for warranty claim. You can claim warranty of goods, file complaints or other motions at WELLDONE s.r.o., Laurinská 19, 811 01 Bratislava.
In the event you wish to claim warranty for goods purchased or picked up at the brick and mortar shop, it is best to do so in person. Do not forget to bring the relevant receipt for the item you wish to claim warranty for.

We do not consider wear and tear due to use and washing that naturally and inevitably occurs as a result of normal wear or aging as reason for warranty claims.

Please remember that goods produced by WELLDONE s.r.o. which you purchased at a place other than the www.kompot.sk e-shop or our brick and mortar shop, can be claimed only at the seller’s you have purchased it at.

9.3.2 Conditions of Warranty Claims
• Notification of a warranty claim or delivery of claimed goods must be executed within 24 months after the date of purchase.
• In the event of warranty claim, you do not need original packaging, ie please return the goods without the mason jar (or without other packaging if appropriate)
• Do not send goods for warranty claims using the “cash on delivery method:, we will not accept such a shipment.

9.3.3 Warranty Claims Process – Customer
• Bring goods you want to claim warranty for in person to Laurinská 19, Bratislava or send it signed for as a package or letter (not “cash on delivery”).
• Address for delivery of claimed goods:

• To claim warranty for goods, you will need a copy of the receipt.
• Make sure the goods for warranty claims are in order, not damaged and without packaging.
• Include a copy of the receipt and accompanying letter specifying the defect in the package or letter with the goods.
• In the event you send goods claimed for warranty by post, it is better to notify us in advance at info@kompot.sk.

9.3.4 Warranty Claims Process – Provider
In person
• We will check the specified defect on the received item and confirm the warranty period based on the purchase receipt.
• We will fill in the warranty claim form in cooperation with the customer.
• We will agree on further steps regarding the warranty claim process and method of contacting the customer.
• We will notify you on the status of the warranty claim in writing within 30 days of the warranty claim filing.

By Post
• We will check the specified defect on the received item and confirm the warranty period based on the purchase receipt.
• Upon receipt of claimed item, we will contact you without delay (by phone or e-mail) and we will discuss the fastest and most efficient solution to your specific situation.
• We will inform you in writing (by e-mail) on further steps regarding the warranty claim process.
• We will send the repaired/exchanged goods to the address specified in e-mail communication.

If we accept your warranty claim, we will proceed with one of the following steps:
• We will repair or exchange the item for another item to you in person in-store or we will send it back bearing the shipment costs.
• If it is not possible to repair or exchange the item, we will reimburse you including the postage and packaging charges.

Consumer Dispute Resolution Using European Online ODR Platform



As of 1st February 2016, as a consumer dissatisfied with the way we have handled your warranty claim or if you believe we breached your rights, you may approach Kompot and demand corrective action by info@kompot.sk. If we reject your claim or do not respond within 30 days of sending, you are entitled to file your claim and assert your rights in relation to us using the method of alternative dispute resolution. The specified subject responsible for alternative consumer dispute resolution in regards to Kompot is the Slovak Trade Inspection (www.soi.sk) or other applicable authorised corporate entity that is registered in the list of subjects for alternative dispute resolution kept by the Ministry of Justice of the Slovak Republic (http://www.mhsr.sk/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov/146987s). In the event that several bodies of alternative dispute resolution are applicable, you are entitled to choose where you want to file your claim; your ability to file at applicable court is hereby not affected. Simultaneously, the consumer can file a demand for alternative dispute resolution using the on-line platform for dispute resolution. On-line dispute resolution is secured by the European Commission and the Slovak contact point for on-line dispute resolution (ODR). You can use the ODR platform by submitting a complaint to http://ec.europa.eu/consumers/odr/index_en.htm.

Using alternative dispute resolution saves time and money, as your complaint will be attended to within 90 days and without significant financial costs. Alternative dispute resolution does not concern disputes where the identifiable dispute value is not at least EUR 20. Authorised corporate entity can demand the consumer to settle a fee for opening an alternative dispute resolution in the maximum value of EUR 5 including VAT. Final Provisions



The Terms and Conditions are valid as of 1 February 2016.

WELLDONE s.r.o. reserves the right to change the Terms and Conditions. The obligation to notify of changes in the Terms and Conditions in writing is fulfilled by placing them on www.kompot.sk.

The Terms and Conditions become effective in regards to you upon entering into a purchase contract.
